This Privacy Policy describes how Factoryplay Active Brands ("Factoryplay", "we") processes personal data collected through activebrands.pro, in compliance with the EU General Data Protection Regulation (Regulation EU 2016/679) and Portuguese Law no. 58/2019. By using this site or submitting a quote request, you agree to the terms described below.

1. Data controller

The controller of your personal data is Factoryplay, headquartered in Portugal. For any data-related enquiry please contact us at [email protected].

2. What data we collect

We only collect data strictly necessary to handle your requests:

  • Quote request: name, company, email, phone, location, product/model, dimensions, quantity, delivery date, notes and any artwork files you attach (PDF, JPG, PNG, SVG, AI).
  • Direct contact: name, email and message content.
  • Technical data: your browser sends standard technical info (IP, user-agent) to our server to serve the site; this is not retained for tracking purposes.

3. Purposes and legal basis

  • Responding to quote and contact requests — pre-contractual measures at the data subject's request (Art. 6(1)(b) GDPR).
  • Performance of a contract if we move forward — Art. 6(1)(b).
  • Compliance with legal obligations (invoicing, tax) — Art. 6(1)(c).
  • Internal management and service improvement — legitimate interests (Art. 6(1)(f)), balanced against your rights.

4. Processors and transfers

Your data is processed by us and may be shared with infrastructure providers under contract and confidentiality obligations:

  • Postmark (ActiveCampaign LLC) — transactional email delivery. May involve transfer to the US under the European Commission's Standard Contractual Clauses.
  • Microsoft Azure (EU) — database and file storage.
  • Coolify / Hetzner Online (EU) — application hosting.
  • Cloudflare — CDN and traffic protection.

5. Retention periods

We keep your data only as long as needed for the purpose collected:

  • Unconverted quote requests: up to 24 months, to allow follow-up.
  • Active customers: throughout the contract and applicable legal periods (10 years for accounting records).
  • After those periods, data is deleted or anonymised.

6. Your rights

As a data subject you have the right to:

  • Access your data and obtain a copy;
  • Request rectification of inaccurate data;
  • Request erasure ("right to be forgotten") where applicable;
  • Request restriction of processing or object to it;
  • Request data portability;
  • Withdraw consent, where consent is the legal basis, without affecting prior lawfulness.

7. Cookies and local storage

This site uses technical localStorage only — to remember your theme preference (light/dark) and the cookie notice state. That data stays in your browser and is not transmitted.

We use Plausible Analytics, self-hosted at plausible.outsmartis.dev, for aggregate traffic statistics. Plausible is a European, privacy-friendly alternative to Google Analytics: it does not set cookies, does not collect personal data, and does not build user profiles. All data processed is aggregated and anonymised (see plausible.io/data-policy).

We do not use advertising cookies, remarketing pixels, or any cross-site tracking tool.

8. Changes to this policy

We may update this policy when needed, reflecting legal changes or service changes. The last-updated date is shown at the top of this page. We recommend reviewing it periodically.
